Terms of Service

These Terms of Service ("Terms") govern your access to and use of [App Name] (the "Service"), operated by [Company Name] ("we", "us", "our"). By creating an account, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and legally able to enter contracts to use the Service. By using the Service, you represent that you meet these requirements.

2. Account & Workspace

You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access. Each workspace is a separate billing entity — you may not share workspaces across unrelated businesses.

3. Free Trial

New accounts receive a 14-day free trial with a limited credit balance. At the end of the trial, your account will be suspended unless you subscribe to a paid plan. We will send reminder emails at 7, 3, and 1 day before expiration. Unused trial credits do not carry over to paid plans.

4. Subscriptions & Billing

• Plans are billed monthly or annually in advance.
• All prices are in USD and exclude applicable taxes.
• Subscriptions renew automatically unless cancelled before the renewal date.
• You may cancel anytime; access continues until the end of the current billing period.
• Refunds are not provided for partial billing periods, except where required by law. Contact us within 48 hours of a charge if you believe it was made in error.
• We reserve the right to change prices. We will notify you at least 30 days in advance for increases. Continued use after the change constitutes acceptance.

5. Credits

The Service operates on a credit system. Credits are consumed when generating images, videos, avatar videos, and other AI content. Credits are non-transferable, non-refundable, and expire at the end of each billing cycle unless stated otherwise. Credit costs may change; we will update the pricing page and notify you in advance.

6. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, defamatory, harassing, hateful, or pornographic.
• Infringe third-party intellectual property, privacy, or publicity rights.
• Impersonate any person or entity.
• Spread misinformation or deliberately misleading content.
• Circumvent rate limits, credit checks, or other technical controls.
• Reverse-engineer, scrape, or resell the Service without written permission.
• Violate any applicable law or regulation.

We may suspend or terminate accounts that violate these rules without prior notice.

7. AI-Generated Content & Responsibility

You own the output content generated through the Service, subject to the licenses of our underlying AI providers. You are solely responsible for reviewing content before publishing. We do not guarantee accuracy, originality, or fitness for any purpose. You must not publish AI-generated content that violates applicable laws (e.g., advertising regulations, endorsement disclosures, copyright law).

8. Social Platform Integrations

When connecting social accounts, you must comply with each platform's terms of service. You grant us permission to publish content on your behalf using the access tokens you provide. You may revoke access at any time through your settings.

9. Intellectual Property

The Service and its underlying technology are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute the Service. Your brand assets (logos, images) remain yours; you grant us a limited license to process them to provide the Service.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated content will meet your expectations.

12. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising from your use of the Service is limited to the amount you paid us in the 3 months preceding the claim. In no event will we be liable for indirect, incidental, special, or consequential damages.

13. Indemnification

You agree to indemnify and hold us harmless from claims arising from your use of the Service, your content, or your violation of these Terms or applicable law.

14. Termination

Either party may terminate at any time. We may suspend or terminate your account immediately for violations of these Terms. Upon termination, your data will be retained for 30 days before deletion, except where deletion is required sooner by law.

15. Governing Law

These Terms are governed by the laws of [Jurisdiction], without regard to conflict of law principles. Disputes will be resolved in the courts of [Jurisdiction].
